General Terms and Conditions of the Online Shop

1. Scope
The following terms and conditions exclusively apply to all business relationships between Ju&Mi BV and the customer in the version valid at the time of the order. Customers within the meaning of these terms are adults acting as consumers (§ 13 BGB) or entrepreneurs (§ 14 BGB). Oral side agreements are only valid if confirmed in writing by Ju&Mi BV.

2. Conclusion of the Contract
(1) The presentation of products does not constitute a legally binding offer but rather a non-binding invitation to the customer to place an order with Ju&Mi BV.
By placing an order, the customer makes a binding offer to conclude a purchase contract. The immediate confirmation of receipt of the order and any additional order-related information do not constitute acceptance of the offer. The contract is concluded when Ju&Mi BV accepts the customer’s offer through an explicit order confirmation or dispatches the goods.

(2) The customer expressly has no contractual right of withdrawal. The statutory right of withdrawal pursuant to section 3 remains unaffected. If the customer is not a consumer, they are not entitled to return goods that are in accordance with the contract and free from defects.

3. Right of Withdrawal

(1) Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without stating any reason. The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, took possession of the goods. If several items were ordered and delivered separately, the period begins on the day the last item is received. This also applies to partial deliveries of a single product.

by means of a clear declaration (e.g. letter by post, fax or email) of your decision to withdraw from this contract. You may use the model withdrawal form attached to the order confirmation, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your notice regarding the exercise of the right of withdrawal before the withdrawal period has expired.

(2) Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising from your choice of a different delivery method than the standard, least expensive delivery offered by us), without undue delay and no later than fourteen days from the day we receive your notification of withdrawal. We will use the same means of payment for the refund as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof of having returned the goods, whichever is earlier.
You must return the goods to us without undue delay and in any case no later than fourteen days from the day you notified us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period has expired. You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods if this is due to handling beyond what is necessary to check the nature, characteristics and functioning of the goods.

4. Delivery
(1) Ordered goods are delivered by freight shipping to the customer; delivery is considered complete once the goods are handed over to the customer, a designated person, or a cohabiting household member, unless expressly excluded by the customer. Shipments are insured up to a value of €1,500.00.
(2) Ju&Mi BV strives to deliver complete orders. If this is not possible, partial deliveries are allowed, provided it is reasonable for the customer. No additional shipping or packaging fees will be charged for this.
(3) If a product is not deliverable due to force majeure or production issues without fault of Ju&Mi BV, or if it is lost before delivery and cannot be reasonably replaced, Ju&Mi BV is released from the obligation to deliver. The customer will be informed immediately and any payments already made will be refunded.

5. Prices and Payment Terms
(1) The prices valid at the time of the order as shown on the website apply. All prices are in euros including statutory VAT. Ju&Mi BV will issue the customer an invoice upon delivery.
(2) Payment can be made, depending on the available options and selected method, by credit card, bank transfer, invoice, or PayPal.
(3) If the customer defaults on payment, Ju&Mi BV is entitled to charge the statutory default interest. The right to claim further damages remains unaffected.

6. Packaging and Shipping Costs
(1) Packaging and shipping costs are charged additionally and shown to the customer in advance.
(2) In the event of withdrawal, the customer bears the cost of returning the goods.

7. Retention of Title
The delivered goods remain the property of Ju&Mi BV until full payment is made. In the case of legitimate resale to end customers, the customer assigns their claim against the end customer to Ju&Mi BV up to the outstanding amount.

8. Warranty and Limitation of Liability
(1) For consumers, the statutory warranty rules apply.
(2) For defects reported by customers who are not consumers within the meaning of § 13 BGB, Ju&Mi BV has the right, at its discretion, to remedy or replace. If this is not possible, the customer has the right to reduce the price or withdraw from the contract and/or claim compensation. Legal provisions otherwise apply.
(3) Except in cases of intent or gross negligence, Ju&Mi BV’s liability for contractual and non-contractual breaches is limited to essential contractual obligations that jeopardize the purpose of the contract. Pre-contractual claims remain unaffected. Liability is limited to foreseeable, typical damage and, in the case of insurance, to the insured amount.
(4) The above limitations of liability do not apply in cases of intent or gross negligence, warranties, injury to life, body or health, or statutory product liability.

9. Data Protection
The transmitted data will be stored by Ju&Mi BV exclusively for the purpose of processing the contract. The customer agrees to the storage and use of their personal data for processing orders and deliveries. The customer can revoke their consent at any time with effect for the future. In that case, Ju&Mi BV will delete the data immediately, unless the order is not yet completed or legal retention periods apply. Upon request, Ju&Mi BV will provide information about the stored data at any time. Further details can be found in our privacy policy.

10. Packaging Regulation
Ju&Mi BV is affiliated with a recognized dual system in accordance with legal requirements and uses only registered sales packaging.

11. Final Provisions
(1) The statutory place of jurisdiction applies. If the customer is a merchant, Erfurt shall be the agreed place of jurisdiction. German law applies with the exclusion of the UN Sales Convention.
(2) The invalidity of any provision shall not affect the validity of the contract and the remaining provisions. In case of invalidity, the statutory regulations apply.
