Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without stating any reason.

The withdrawal period is 14 days from the day,

  • on which you or a third party named by you, who is not the carrier, took possession of the goods, provided you ordered one or more goods as part of a single order and they were delivered together;
  • on which you or a third party named by you, who is not the carrier, took possession of the last item, provided you ordered multiple goods in one order and they were delivered separately;
  • on which you or a third party named by you, who is not the carrier, took possession of the last partial shipment or piece, provided you ordered goods delivered in several partial shipments or pieces.

To exercise your right of withdrawal, you must inform us (Ju&Mi BV, Hulhage 8, 9800 Deinze, +32 477 27 68 59, info@qflame.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day we receive your notice of withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.

You bear the direct cost of returning goods that can be shipped by parcel post. For goods that cannot be returned by parcel post, the return cost is 90 EUR.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way not necessary for checking their condition, properties and functioning.


Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts

  • for the supply of goods that are not prefabricated and for which an individual choice or decision by the consumer is essential, or that are clearly tailored to the personal needs of the consumer;
  • for the supply of goods that may spoil quickly or whose expiration date would be quickly exceeded;
  • for the supply of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion and whose current value depends on market fluctuations beyond the entrepreneur’s control;
  • for the supply of newspapers, magazines or illustrated publications, except for subscription contracts.

The right of withdrawal expires prematurely for contracts

  • for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal was removed after delivery;
  • for the delivery of goods which, after delivery, were inseparably mixed with other items due to their nature;
  • for the delivery of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
